Yes, in accordance with the Regulatory Reform (Fire Safety) Order 2005, completing a fire risk assessment for your premises is a legal requirement if you are responsible for a building that is not a ‘single private dwelling’.
The Regulatory Reform (Fire Safety) Order 2005 states that you must have a "competent" person carrying out your fire risk assessment. The Home Office advises that, in choosing a fire risk assessor, preference be given to companies (which can include sole traders), that are certificated by a recognised third-party certification body, or to persons who are certificated as competent to carry out Fire Risk Assessments under a recognised certification scheme or are registered as such by a professional body.
Yes, the Responsible Person(s) can use the technical guides to carry out their own fire risk assessment, but, commonly, the Responsible Person(s) will engage the services of a consultant or another third party (‘a fire risk assessor’) to carry out the fire risk assessment(s) for their premises to ensure that they have employed a "competent person" to carry out the task.
When the report has been completed, the actions noted within must be addressed in line with the priority which the assessor has advised for each. We are also able to advise on post-FRA remedial services.
Having a Fire Risk Assessment in place is a legal requirement, any recommendations which are made within the said report become a legal requirement to complete to ensure that all attendees of your premises are kept safe at all times.
